Terms of Sale


The object is sold in an online auction with bids at www.huutokaupat.com between 8 July and 28 July 2026. Participation requires registration. The deadline for submitting bids ends on 28 July 2026 at 18:00 (or 3 minutes after the last accepted bid).


The Enforcement Authority is not responsible for the service provider’s system. The highest bid is the one the service provider’s system has recorded as highest. The enforcement officer decides whether to accept or reject the highest bid. Bids placed in the online auction are binding. If a bid is accepted, the bidder must pay the offered purchase price within the agreed payment time. Failure to pay the offered price may lead to the buyer’s liability for compensation under Chapter 5, Section 25 of the Enforcement Code.


The enforcement authority reserves the right to end the sale or to extend the sale period.


The property is attached for enforcement and is sold by private sale through the enforcement officer in accordance with Chapter 5, Section 76 of the Enforcement Code and, where applicable, the general auction terms of the Enforcement Code.


Payment terms


The enforcement officer will notify the highest bidder whether the bid can be accepted. If accepted, the buyer pays the full purchase price by bank transfer to the Enforcement Authority’s official account. When the payment is visible on the account, the enforcement officer will issue the sales decision to the parties. The purchase price cannot be paid by credit card.


Deposit: If the full purchase price is not paid immediately, the buyer must pay a deposit of 20% of the purchase price immediately.


Payment period: If the highest bid is accepted, the enforcement officer may, if necessary, grant up to six weeks’ payment time for the remainder of the purchase price from the date of the sales decision. Payment time must be agreed separately. If no payment time is used, the purchase price must be paid immediately after acceptance of the bid. If payment time is granted, annual interest on the full purchase price will be charged under Section 3(2) of the Interest Act for the whole payment period from the date of the sales decision until the end of the payment period. If payment is not made in time, the buyer must pay default interest under Section 4(1) of the Interest Act on the full purchase price until it is paid or the property is resold.


Buyer’s liabilities transferred


The buyer must pay the transfer tax, which is 1.50% of the total of the purchase price and any unpaid company receivables and charges related to the apartment and the company loan. The transfer tax is paid to the tax authority. The buyer must present proof of payment of the transfer tax before delivery of the share certificate and the deed of sale.


The buyer must apply to the National Land Survey for registration of ownership of the shareholder apartment within 2 months of signing the deed of sale. The Enforcement Authority will hand over a paper share certificate with a transfer note to the buyer together with the deed of sale; the buyer will submit this to the Land Survey for cancellation during registration. The Land Survey charges a fee for registering the apartment, payable by the buyer.


Liability for company loan shares:
Resolution of the general meeting on 15 April 2026: to finance the roof repair project the board is authorised to negotiate and raise a capital loan of up to €400,000 and to pledge, and if necessary obtain and pledge, the bank-required mortgage deeds on company assets as security. Repayment of loan shares may be required once the project is completed and accepted. The board is authorised to decide the amount and start of any capital charge according to the loan terms.


The company loan share related to the apartment remains the buyer’s responsibility and is not paid from the purchase price.


Taking into the housing company’s possession:

The apartment has been taken into the company’s possession for three years by the general meeting decision made on 27 February 2025. The possession decision gives the company the right to rent the apartment to cover arrears in charges and other payments. Under the Housing Companies Act, Chapter 8, Section 7, the new owner of the sold shares will obtain possession of the apartment when they have paid to the company all arrears that may be covered with rent from the apartment under Chapter 8, Section 6(2). These arrears consist of unpaid company charges and other payments that are the basis for taking the apartment into possession, and any charges and other payments that fall due to be paid during the possession period. According to the property manager’s certificate, the buyer’s liability is €3,124.97 as at 26 June 2026. The amount changes monthly. The buyer must clarify and pay arrears directly to the housing company. These are not deducted from the purchase price paid to the Enforcement Authority.


The buyer must independently ensure that obligations relating to the apartment and the housing company are fulfilled. Bids in the online auction should take these matters into account.


If it is not possible to place a bid via Huutokaupat.com, a prospective buyer may submit a written bid to the enforcement officer. The bid will be entered into the online auction as a maximum bid in the auto-bidding system. The written bid must be submitted to the Enforcement Authority no later than 24 July 2026 at 12:00 to the address: Utsökningsverket / Kuusamo activity office, Kaiterantie 20, 93600 Kuusamo. A written bid is binding and subject to the same terms as the online auction. The written bid must be signed and must state the bidder’s contact details, the maximum bid amount and the number of the object in Huutokaupat.com to which the bid applies.
