Terms of Sale

Method of submitting bids

The property is sold by ascending bids in an online auction held on www.huutokaupat.com. Participation requires registration. The deadline for submitting bids is 19 November 2026 at 16:00 or two minutes after the latest bid.

The National Enforcement Authority Finland is not responsible for the functioning of the service provider’s system. The highest bid is the bid accepted as highest by the service provider’s system. The enforcement officer separately decides whether to accept or reject the highest bid.

If it is not possible to submit purchase bids through Huutokaupat.com, a prospective buyer may submit a written purchase bid to the enforcement authority, which will be added to the online auction as a maximum bid according to the automatic bidding system. The written bid must be signed and state the bidder’s contact details, the maximum bid and the item number on Huutokaupat.com to which the bid relates. The written purchase bid is binding and is subject to the same terms as the online auction. The bid must be submitted by 17 November 2026 at 16:15 to the Oulu office of the National Enforcement Authority Finland, Torikatu 34–40, 90100 Oulu, or by email to oulu.realisointi.uo@oikeus.fi.

The enforcement authority reserves the right to end the sale or extend the sale period.

Buyer’s liability for compensation

Bids submitted in the online auction and in writing are binding. If a bid is accepted, the bidder must pay the offered purchase price within the stated payment period. Failure to pay may result in the buyer’s liability for compensation under Chapter 5, section 25 of the Enforcement Code.

Minimum bid increment

€100

Lowest acceptable bid

€450.00

The enforcement officer may not accept the highest bid if, in the officer’s assessment, it is clearly below the fair local value of the property.

Payment terms

Deposit

The buyer must immediately pay 20% of the purchase price as a deposit into the National Enforcement Authority’s official funds account. The deposit cannot be paid by credit card. The National Enforcement Authority will contact the bidder whose accepted bid is highest. The highest bidder must state on whose behalf the bid was made. Otherwise, the highest bidder will be deemed the buyer.

Payment period

Where necessary, up to six weeks may be granted to pay the balance of the purchase price. The payment period will be notified separately. If a payment period is used, annual interest under section 3(2) of the Interest Act is payable on the entire purchase price for the agreed period, from the date of sale until the end of the payment period.

If no payment period is used, the purchase price must be paid without delay after acceptance of the bid.

If payment is not made within the specified period, the buyer must pay late-payment interest under section 4(1) of the Interest Act on the entire purchase price until it has been paid or a new sale has taken place. The current late-payment interest rate is 9.50%.

Liabilities and rights transferred to the buyer

The buyer assumes liability for the previous owner’s unpaid maintenance charges and other payments.

The shares for sale are subject to unpaid maintenance charges of €22,997.40 as at 19 August 2026. According to the property manager’s statement, the apartment is also liable for €542.98 in repossession costs.

The apartment has been taken into the company’s possession for three years from 29 June 2026. Under the Limited Liability Housing Companies Act, the new owner has the right to obtain possession before the end of this period if the buyer pays the costs of taking possession, any costs incurred by the company for repairing the apartment, unpaid company charges and charges falling due for payment by the shareholder during the period of possession.

According to the property manager’s certificate, the housing company has not let the apartment. However, the apartment is subject to a tenancy agreement entered into by the previous owner.

The amount of the receivables may increase by the time the sale decision is made and ownership transfers.

Housing-company loan shares relating to the apartment

In addition to the purchase price payable in money, the buyer assumes the housing-company loan share relating to the apartment, totalling €11,514.76 (€9,715.31 for PO1 and €1,799.45 for PO3) as at 31 August 2026.

The housing-company loan share remains payable by the buyer and is not paid from the purchase price.

The buyer must arrange payment to the housing company of all liabilities relating to the apartment for which the buyer is responsible. Online auction bids must take these matters into account. Payment of the housing-company loans is not a condition for obtaining possession of the apartment.

Tenancy agreement

The apartment is let under an open-ended tenancy agreement commencing on 1 October 2021. The agreement was entered into by the apartment’s owner. Under the agreement, the rent is €495 per month.

Under Chapter 5, section 39 of the Act on Residential Leases, the buyer of shares sold in enforcement proceedings has the right to terminate the tenancy agreement within one month of taking possession of the apartment. The notice period is determined in accordance with the Act on Residential Leases.

Transfer tax

The buyer must pay transfer tax of 1.5%. The tax is calculated on the total purchase price and liabilities assumed by the buyer, as at the date of transfer of ownership.

Transfer of possession and ownership

The buyer obtains possession of the property when the full purchase price and any liabilities assumed by the buyer have been paid and the housing company has ended its possession of the apartment. The buyer may not use the property in a manner that reduces its value before receiving the deed of sale.

The buyer obtains ownership of the property upon receiving the deed of sale. The deed is delivered when the sale is final and the full purchase price and transfer tax have been paid.

Registration of ownership

The housing company has transferred the register of shares to the Residential and Commercial Property Information System maintained by the National Land Survey of Finland. The buyer must apply to register ownership within two months of the date of the deed of sale. The National Land Survey cancels the paper share certificate when ownership is registered. The buyer is responsible for the registration costs.

Other information

The property has been seized and is sold by a private sale conducted by the enforcement officer, applying as appropriate the general auction terms laid down in the Enforcement Code.

The sales prospectus is indicative and is not a comprehensive description of the property.

Buyers are advised to examine the property, the sales prospectus and the attached documents carefully before submitting a bid.

Appeal

An enforcement appeal against the sale or an act related to or preceding the sale must be filed within three weeks of the sale. Instructions for appeal are attached to the sale decision.
