Participation in the auction requires registration. The Enforcement Authority is not responsible for the functionality of the service provider’s system. The highest bid is the bid that the service provider’s system has accepted as highest. The enforcement officer will separately decide to approve or reject the highest bid within seven working days of the end of the online auction. Acceptance of the bid and payment instructions will be notified to the buyer separately.

Bids are made on the purchase price, which does not include any amounts payable by the buyer under the Companies Act on housing companies (see the sales prospectus section on obligations and rights transferred to the buyer). Any charges owed to the housing company must be paid directly to the company; the purchase price paid to enforcement does not reduce those charges in any way.

Bids submitted in the online auction are binding. If an accepted bid is approved, the bidder is obliged to pay the offered purchase price within the agreed payment period. Failure to pay the offered purchase price may lead to the buyer’s liability for compensation under Chapter 5, Section 25 of the Enforcement Code. The enforcement authority reserves the right to end the sale or to extend the sale period.

Payment terms: The buyer must immediately pay a deposit of 20 per cent of the purchase price into the Enforcement Authority’s official account. The deposit cannot be paid by credit card. If the highest bid is approved, payment time of up to six weeks may be granted for the remainder of the purchase price if necessary. If no payment time is used, the purchase price must be paid immediately after acceptance of the bid. If payment time is granted, annual interest will accrue on the whole purchase price for the payment period from the sale date to the end of the payment period in accordance with section 3(2) of the Interest Act.

Appeals: An enforcement appeal concerning the sale and any actions related to or preceding the sale must be lodged within three weeks from the date of sale. The notice of appeal procedure is attached to the sale decision.

Sales conditions:

The property is seized and is sold under the authority of the enforcement officer in accordance with Chapter 5, Section 76 of the Enforcement Code and the code’s general auction terms. The enforcement officer may approve or reject the highest bid. More information is available in the sales prospectus.
