Participation in the auction requires registration. The Enforcement Authority is not responsible for the functionality of the service provider’s system. The highest bid is the bid that the service provider’s system has registered as highest. The bailiff will decide on the acceptance or rejection of the highest bid separately within seven working days of the end of the online auction. Acceptance of the bid and payment instructions will be notified to the buyer separately.

Bids are made on the purchase price, which does not include amounts payable to the housing company under the Housing Companies Act (see the sales brochure section on obligations and rights transferring to the buyer). Any amounts due to the housing company must be paid directly to the company; the purchase price paid to enforcement will not reduce those amounts.

Bids placed in the online auction are binding. If a bid is accepted, the bidder is obliged to pay the offered purchase price within the agreed payment period. Failure to pay the offered purchase price may lead to the buyer’s liability for compensation under section 25 of chapter 5 of the Enforcement Code.

The Enforcement Authority reserves the right to end the sale or to extend the sale period.

Payment terms: The buyer must immediately pay a deposit of 4% of the purchase price to the Enforcement Authority’s official account. The deposit cannot be paid by credit card. If the highest bid is accepted, a payment period of up to six weeks may be granted for the remaining purchase price if necessary. If no payment period is used, the purchase price must be paid immediately after acceptance. If a payment period is used, annual interest in accordance with section 3(2) of the Interest Act will be charged on the whole purchase price for the entire payment period from the date of sale until the end of the payment period.

Appeals: An enforcement appeal against the sale and any action related to or preceding the sale must be made within three weeks from the date of sale. Appeal instructions are attached to the sale decision.

Terms of sale:

The property is seized and sold privately by the bailiff in accordance with section 76 of chapter 5 of the Enforcement Code and the Enforcement Code’s general auction terms. The bailiff may accept or reject the highest bid submitted. More information is available in the sales prospectus.

Bids refer to the purchase sum to be paid in full to the Enforcement Authority. See the sales prospectus for information on any loan shares, unpaid company maintenance charges and other obligations or costs for which the new owner will also be responsible or liable to pay to obtain possession of the share apartment.
