Terms of Sale

How bids are submitted

The property is sold by ascending bids in an online auction held on www.huutokaupat.com. Participation in the auction requires registration. The deadline for bids is 19/11/2026 at 18:00 or two minutes after the latest bid.

The National Enforcement Authority Finland is not responsible for the functionality of the service provider’s system. The highest bid is the bid accepted as the highest by the service provider’s system. The enforcement officer separately decides whether to accept or reject the highest bid.

If it is not possible to submit purchase bids through the Huutokaupat.com service, a prospective buyer may submit a written purchase bid to the enforcement authority, which will be added to the online auction as a maximum bid under the automatic bidding system. The written bid must be signed and state the bidder’s contact details, maximum bid and the Huutokaupat.com item number concerned. The written purchase bid is binding and subject to the same terms as the online auction. The bid must be submitted by 17/11/2026 at 16:15 to the National Enforcement Authority Finland’s Oulu office, Torikatu 34–40, 90100 Oulu, or by email to oulu.realisointi.uo@oikeus.fi.

The enforcement authority reserves the right to end the sale or extend the sale period.

Buyer’s liability for compensation

Bids submitted in the online auction are binding. If a bid is accepted, the bidder must pay the offered purchase price within the stated payment period. Failure to pay the offered purchase price may result in the buyer’s liability for compensation under Chapter 5, section 25 of the Enforcement Code.

Minimum bid increment

€100

Lowest acceptable bid

€450.00

The enforcement officer may not accept the highest bid if, in the officer’s assessment, the bid is clearly below the property’s fair local market value.

Payment terms

Deposit

The buyer must immediately pay 20% of the purchase price as a deposit to the National Enforcement Authority Finland’s official funds account. The deposit cannot be paid by credit card. The National Enforcement Authority Finland will contact the bidder whose highest bid has been accepted. The highest bidder must state on whose behalf the bid was made. Otherwise, the highest bidder will be deemed the buyer.

Payment period

Where necessary, a payment period of up to six weeks may be granted for the balance of the purchase price. The payment period will be notified separately. If a payment period is used, annual interest under section 3(2) of the Interest Act must be paid on the entire purchase price for the agreed period, from the date of sale until the end of the payment period.

If no payment period is used, the purchase price must be paid without delay after the bid is accepted.

If payment is not made within the specified period, the buyer must pay late-payment interest under section 4(1) of the Interest Act on the entire purchase price until it is paid or a new sale has taken place. The current late-payment interest rate is 9.50%.

Obligations and rights transferred to the buyer

The buyer assumes liability for obligations arising from the previous owner’s unpaid maintenance charges and other payments.

The shares for sale are subject to unpaid maintenance charges of €7,202.36 as at 19/08/2026. In addition, according to the property manager’s notification, the apartment is liable for possession-taking costs of €542.98.

The apartment has been taken into the company’s possession for three years from 29/06/2026. Under the Housing Companies Act, the new owner has the right to obtain possession before the end of the possession period if the buyer pays the costs arising from taking possession of the apartment, any costs incurred by the company for repairing the apartment, unpaid company maintenance charges and those charge instalments falling due for payment by the shareholder during the possession period.

According to the property manager’s certificate, the housing company has not rented out the apartment. However, the apartment is subject to a tenancy agreement entered into by the previous owner.

The amount of the receivables may increase by the time the sale decision is made and ownership is transferred.

Company-loan shares relating to the apartment

In addition to the purchase price paid in money, the buyer assumes the company-loan share relating to the apartment, €892.29 as at 31/08/2026.

The company-loan share relating to the apartment remains payable by the buyer and is not paid from the purchase price.

The buyer must independently ensure that obligations relating to the apartment for which they are responsible are paid to the housing company. Bids submitted in the online auction must take these matters into account. Payment of company loans is not a prerequisite for obtaining possession of the apartment.

Tenancy agreement

The apartment is rented under an open-ended tenancy agreement commencing on 01/05/2020. The agreement was entered into by the apartment’s owner. Under the agreement, the rent is €380 per month.

Under Chapter 5, section 39 of the Act on Residential Leases, the buyer of shares sold in enforcement proceedings has the right to terminate the apartment’s tenancy agreement within one month of taking possession of the apartment. The notice period is determined under the Act on Residential Leases.

Transfer tax

The buyer must pay transfer tax of 1.5%. The tax is calculated on the total purchase price and obligations transferred to the buyer, as at the date ownership is transferred.

Transfer of possession and ownership

The buyer obtains possession of the sale property once the full purchase price and any obligations transferred to the buyer have been paid. The buyer may not use the property in a manner that reduces its value before receiving the deed of sale.

The buyer obtains ownership of the sale property upon receiving the deed of sale. The deed is delivered once the sale is legally final and the full purchase price and transfer tax have been paid.

Registration of ownership

The housing company has transferred its share register to the apartment information system maintained by the National Land Survey of Finland. The buyer must apply to register ownership within two months of the date of the deed of sale. The National Land Survey of Finland cancels the paper share certificate when ownership is registered. The buyer is responsible for the registration costs.

Other information

The property has been seized and is sold by a free sale conducted by the enforcement officer, applying as appropriate the general auction terms laid down in the Enforcement Code.

The sales brochure is indicative and is not a comprehensive description of the sale property.

Buyers are advised to examine the sale property, sales brochure and attached documents carefully before submitting a bid.

Appeals

An enforcement appeal concerning the sale or an act related to or preceding the sale must be made within three weeks of the sale. Instructions for appeal are attached to the sale decision.
