Terms of Sale

The property is sold in an online auction held on the website www.huutokaupat.com. Participation requires registration. The deadline for submitting bids closes on 7 April 2026 at 18:00 (or 3 minutes after the last accepted bid).


The Enforcement Authority is not responsible for the service provider’s system. The highest bid is the bid that the service provider’s system has accepted as highest. The enforcement officer decides whether to accept or reject the highest bid. Bids made in the online auction are binding. If a bid is accepted, the bidder is obliged to pay the offered purchase price within the agreed payment period. Failure to pay the offered purchase price may lead to the buyer’s liability under Chapter 5, Section 25 of the Enforcement Code.


The enforcement authority reserves the right to end the sale or to extend the sale period.


If registration is not possible, a written purchase offer may be submitted. A written offer must be received by the Enforcement Authority by post or email no later than 31 March 2026 at 16:15. The property is seized and is sold by private sale arranged by the enforcement officer in accordance with Chapter 5, Section 76 of the Enforcement Code and, where applicable, the general auction terms set out in the Code.


Payment terms

The enforcement officer will inform the highest bidder whether the bid can be accepted. If the bid can be accepted, the buyer must pay the full purchase price by bank transfer to the Enforcement Authority’s official account. When the payment is visible on the account, the enforcement officer will issue the sales decision, which will be delivered to the parties. Payment by credit card is not accepted.


Deposit: If the full purchase price is not paid immediately, the buyer must pay a deposit of 20% of the purchase price immediately.


Payment period: If necessary, up to six weeks’ extension may be granted from the date of the sales decision. Interest will be charged on the full purchase price for the whole payment period from the sale date to the end of the payment period. The reference rate is currently 2.50%. If payment is not made within the granted period, default interest will be charged thereafter, currently 9.50% per annum.


Liabilities transferred to the buyer

The buyer must pay the transfer tax, which is 1.50% of the total of the purchase price and any unpaid company receivables, charges and company loan related to the flat. The transfer tax is paid to the tax authority. The buyer must present proof of payment of the transfer tax before the share certificate is handed over and the deed is issued.


The buyer is obliged to apply for registration of ownership of the shareholder apartment with the National Land Survey within 2 months of signing the deed. The Enforcement Authority will hand over a paper share certificate with transfer entry together with the deed; the buyer must submit this to the National Land Survey for cancellation upon registration. The National Land Survey will charge a fee for registration, which is payable by the buyer.


The manager’s certificate does not contain entries of arrears or possession costs. The new owner is not liable for unpaid charges or fees of the previous owner that are not recorded in the manager’s certificate and that fell due before the date of the certificate (Housing Companies Act 3:7 §, paragraph 3).


Liability for company loan shares:

The buyer is responsible for any company loan shares relating to the flat. According to the manager’s certificate dated 9 March 2026, the housing company has no company loan.


Liability for unpaid maintenance charges:

The buyer is liable to the housing company for unpaid maintenance charges and usage fees of the previous owner, but only up to the amount equal to the sum of the maintenance charges for the month when ownership transfers and the five immediately preceding months. The manager’s certificate does not indicate that the company had receivables from the shareholder at the time of the certificate. The new owner is not liable for unpaid charges or fees of the previous owner that are not recorded in the manager’s certificate and that fell due before the date of the certificate (Housing Companies Act 3:7 §, paragraph 3). Under the Housing Companies Act, Chapter 3, Section 6, the new owner is responsible for new charges from the date ownership transfers.


Obtaining possession of a flat that is in the housing company’s possession:

By decision of the housing company’s general meeting on 4 October 2024, the flat was taken into the company’s possession for up to three years because of unpaid maintenance charges and usage fees. The buyer will receive possession of the share apartment from the housing company only after paying to the company all unpaid maintenance charges, usage fees and the costs of taking the flat into possession. The manager’s certificate does not show receivables against the shareholder at the time of the certificate. The new owner is not liable for unpaid charges or fees of the previous owner that are not recorded in the manager’s certificate and that fell due before the date of the certificate (Housing Companies Act 3:7 §, paragraph 3).


Tenancy right affecting a flat in the housing company’s possession:

By decision of the housing company’s general meeting on 4 October 2024, the flat was taken into the company’s possession for up to three years because of unpaid maintenance charges and usage fees. According to the manager’s certificate, the share was rented, but according to information from the chairman of the board on 9 March 2026, the tenancy ended on 28 February 2026 and the share is not currently rented. The binding nature of the tenant’s right towards the new owner is governed by the Residential Tenancies Act. The tenant’s right to retain possession ends, however, without notice at the latest when the company’s period of taking possession expires, regardless of any agreed tenancy term.
