Bids and the sales decision

The property is subject to a reserve price. If the reserve price is met, the Municipality of Rusko will sell the plot to the bidder who has made the highest bid. However, the closing of the auction or placing the highest bid does not yet constitute a binding property transaction. The final transaction will only be concluded after the competent authority has made the sales decision and the deed of sale has been signed.

If the reserve price is not met, the Municipality of Rusko reserves the right to accept or reject the highest bid or not to sell the property. The Municipality of Rusko also reserves the right to discontinue the sales procedure or not to sell the property.

The property is sold as a transaction between the users. Huutokaupat.com is not a party to the transaction. By placing a bid, the bidder accepts these terms of sale and the current auction terms of Huutokaupat.com.

Bidders undertake that their contact details may be disclosed by Huutokaupat.com to the Municipality of Rusko for the purpose of making the sales decision and communicating it.

Publicity of bids

All bids are public. Bids made in the auction are visible in the property listing on the Huutokaupat.com service.

Inspecting the property

Before placing a bid, the bidder must inspect the plot, its location and terrain conditions, as well as all documents attached to the listing.

The bidder is solely responsible for obtaining all information necessary for their purchase decision before placing a bid.

The plot is sold in the condition it is in at the time of the transaction. By placing a bid, the bidder accepts the property as is. The descriptions in the listing are solely the seller’s assessments of the property for sale.

No warranty is provided for the property. The property is not subject to any right of exchange or return.

Information provided by the seller

The Municipality of Rusko warrants that it has provided the material information in its possession that may be assumed to affect the transaction.

Building obligation

The buyer undertakes to build a residential building intended for permanent residence in accordance with the local detailed plan, building regulations, building guidelines and approved plans. Within three (3) years of the transaction, the building must have reached a stage of completion at which the building control authority can approve it at the commissioning inspection.

Construction method

Construction must comply with the valid local detailed plan.

Transfer of an undeveloped plot

An undeveloped plot may not be sold or otherwise transferred without the written consent of the Municipality of Rusko.

Contractual penalties

A contractual penalty may be imposed for breach of the building obligation or restriction on further transfer, as specified in more detail in the transfer documents.

Connections and other costs

The buyer is responsible for all costs related to construction.

The buyer is responsible for connection charges in accordance with the tariffs in force at the time, as well as electricity, telecommunications and other connections.

The buyer is responsible for transfer tax, title registration costs, any costs of witnessing the transaction and other official fees related to the property transaction.

The seller is responsible for taxes and charges imposed on the property until title passes, after which responsibility transfers to the buyer.

Placement of cables and equipment

The property owner permits the placement on the property of cables, equipment and structures serving the community or property, in accordance with applicable legislation.

Any inconvenience or damage will be compensated in a separately agreed manner.

Transfer of the plot

A separate decision on the transfer of the plot will be made in accordance with the valid delegation of authority of the Municipality of Rusko.

The final transaction will be completed using a deed of sale prepared by the Municipality of Rusko.

The deed of sale must be signed within three (3) months of the sales decision, unless otherwise agreed.

The purchase price must be paid in full into the account specified in the deed of sale within fourteen (14) days of signing the deed of sale.

Title and possession pass to the buyer when the purchase price has been paid in full.

Withdrawal from the transaction

A party who, without legal grounds, refuses to complete the transaction after a bid has been accepted must, in accordance with the Code of Real Estate, reimburse the other party for reasonable costs incurred from advertising, inspecting the property and other necessary measures related to completing the transaction.
