Bids and sales decision

The property is subject to a reserve price. If the reserve price is met, Rusko Municipality will sell the plot to the bidder who has made the highest bid. However, the end of the auction or the submission of the highest bid does not yet constitute a binding property sale. The final sale is concluded only after the competent authority has made a sales decision and the deed of sale has been signed.

If the reserve price is not met, Rusko Municipality reserves the right to accept or reject the highest bid or not to sell the property. Rusko Municipality also reserves the right to interrupt the sales procedure or not to sell the property.

The property is sold as a transaction between users. Huutokaupat.com is not a party to the transaction. By submitting a bid, the bidder accepts these terms of sale and Huutokaupat.com’s current auction terms.

Bidders undertake that their contact details may be disclosed by Huutokaupat.com to Rusko Municipality for the purpose of making the sales decision and notifying the parties of it.

Publicity of bids

All bids are public. Bids made in the auction are visible in the property listing on the Huutokaupat.com service.

Inspecting the property

Before submitting a bid, the bidder must familiarise themselves with the plot, its location, terrain conditions and all documents attached to the listing.

The bidder is solely responsible for obtaining all information necessary for their purchase decision before submitting a bid.

The plot is sold in the condition in which it is at the time of the transaction. By submitting a bid, the bidder accepts the property as is. The descriptions in the listing are only the seller’s assessments of the property for sale.

No warranty is provided for the property. The property is not subject to any right of exchange or return.

Information provided by the seller

Rusko Municipality warrants that it has provided the material information known to it that can be assumed to affect the transaction.

Building obligation

The buyer undertakes to build a residential building intended for permanent occupation in accordance with the local detailed plan, building regulations, building guidelines and approved plans. Within three (3) years of the transaction, the building must have reached a stage of completion at which the building control authority can approve it at the commissioning inspection.

Building method

Construction must comply with the applicable local detailed plan.

Transfer of an undeveloped plot

An undeveloped plot may not be sold or otherwise transferred without the written consent of Rusko Municipality.

Contractual penalties

A contractual penalty may be imposed for breaching the building obligation or the restriction on onward transfer, as specified in more detail in the transfer documents.

Connections and other costs

The buyer is responsible for all costs related to construction.

The buyer is responsible for connection charges in accordance with the rates in force from time to time, as well as electricity, telecommunications and other connections.

The buyer is responsible for transfer tax, title registration costs, any costs for a public purchase witness and other official charges related to the property transaction.

The seller is responsible for taxes and charges levied on the property until ownership is transferred, after which responsibility passes to the buyer.

Placement of cables and equipment

The property owner permits cables, equipment and structures serving the community or property to be placed on the property in accordance with applicable legislation.

Any inconvenience or damage will be compensated in a separately agreed manner.

Transfer of the plot

A separate decision on the transfer of the plot will be made in accordance with Rusko Municipality’s applicable delegation of authority.

The final sale will be concluded using a deed of sale prepared by Rusko Municipality.

The deed of sale must be signed within three (3) months of the sales decision, unless otherwise agreed.

The purchase price must be paid in full into the account specified in the deed of sale within fourteen (14) days of signing the deed.

Ownership and possession pass to the buyer once the purchase price has been paid in full.

Withdrawal from the transaction

A party who, without legal grounds, refuses to complete the transaction after an accepted bid must, in accordance with the Code of Real Estate, reimburse the other party for reasonable costs incurred from advertising, inspecting the property and other necessary actions related to concluding the transaction.
