Bids and sale decision

The property is subject to a reserve price. If the reserve price is met, the Municipality of Rusko will sell the plot to the bidder who has made the highest bid. However, the end of the auction or submission of the highest bid does not yet constitute a binding property transaction. The final sale takes place only after a sale decision has been made by the competent authority and the deed of sale has been signed.

If the reserve price is not met, the Municipality of Rusko reserves the right to accept or reject the highest bid or leave the property unsold. The Municipality of Rusko also reserves the right to discontinue the sale process or leave the property unsold.

The property is sold as a transaction between users. Huutokaupat.com is not a party to the transaction. By submitting a bid, the bidder accepts these terms of sale and Huutokaupat.com’s current auction terms.

Bidders undertake that their contact details may be disclosed by Huutokaupat.com to the Municipality of Rusko for making the sale decision and communicating it.

Publicity of bids

All bids are public. Bids made in the auction are visible in the property listing on the Huutokaupat.com service.

Inspecting the property

Before submitting a bid, the bidder must familiarise themselves with the plot, its location, terrain conditions and all documents attached to the listing.

The bidder is solely responsible for obtaining all information necessary for their purchase decision before submitting a bid.

The plot is sold in the condition in which it is at the time of sale. By submitting a bid, the bidder accepts the property as is. The descriptions in the listing are solely the seller’s estimates of the property being sold.

No warranty is provided for the property. There is no right of exchange or return.

Information provided by the seller

The Municipality of Rusko confirms that it has provided all material information in its possession that may be assumed to affect the transaction.

Building obligation

The buyer undertakes to build a residential building intended for permanent residence in accordance with the local detailed plan, building regulations, building guidelines and approved plans. Within three (3) years of the sale, the building must have reached a stage of completion at which the building control authority can approve it at the commissioning inspection.

Construction method

Construction must comply with the valid local detailed plan.

Transfer of an undeveloped plot

An undeveloped plot may not be sold or otherwise transferred without the written consent of the Municipality of Rusko.

Contractual penalties

A contractual penalty may be imposed for breaching the building obligation or restriction on further transfer, as specified in more detail in the transfer documents.

Connections and other costs

The buyer is responsible for all costs related to construction.

The buyer is responsible for connection fees in accordance with the tariffs in force from time to time, as well as electricity, telecommunications and other connections.

The buyer is responsible for transfer tax, title registration costs, any costs for authentication of the sale and other official charges related to the property transaction.

The seller is responsible for taxes and charges imposed on the property until ownership is transferred, after which responsibility passes to the buyer.

Placement of cables and equipment

The property owner permits cables, equipment and structures serving the community or property to be placed on the property in accordance with applicable legislation.

Any inconvenience or damage will be compensated in a manner agreed separately.

Transfer of the plot

A separate decision on the transfer of the plot will be made in accordance with the Municipality of Rusko’s current rules on powers of authority.

The final sale will be completed using a deed of sale prepared by the Municipality of Rusko.

The deed of sale must be signed within three (3) months of the sale decision, unless otherwise agreed.

The purchase price must be paid in full into the account stated in the deed of sale within fourteen (14) days of signing the deed of sale.

Ownership and possession transfer to the buyer once the purchase price has been paid in full.

Withdrawal from the sale

A party who, after an accepted bid, refuses without legal grounds to complete the sale must, in accordance with the Code of Real Estate, compensate the other party for reasonable costs incurred in advertising, inspecting the property and carrying out other necessary actions related to completing the sale.
