Participation in the auction requires registration. The Enforcement Authority is not responsible for the operation of the service provider’s system. The highest bid is the bid that the service provider’s system has accepted as highest. The enforcement officer will decide on accepting or rejecting the highest bid separately within seven working days of the end of the online auction. Acceptance of a bid and payment instructions will be notified to the buyer separately.

Bids are made on the purchase price, which does not include amounts payable by the buyer to the housing company under the Housing Companies Act (see the sales brochure section on obligations and rights transferred to the buyer). The buyer must pay the housing company’s receivables directly to the housing company; the purchase price paid to enforcement does not reduce those amounts in any way.

Offers made in the online auction are binding. If an offer is accepted, the bidder is obliged to pay the offered purchase price within the agreed payment period. Failure to pay the offered purchase price may lead to the buyer’s liability to compensate under section 25 of chapter 5 of the Enforcement Code.

The enforcement authority reserves the right to terminate the sale or extend the sale period.

Payment terms: The buyer must immediately pay a deposit of €5,000 into the Enforcement Authority’s official account. The deposit cannot be paid by credit card. If the highest bid is accepted, a payment period of up to six weeks may be granted for the remainder of the purchase price if needed. If the payment period is not used, the purchase price must be paid immediately after the offer is accepted. If a payment period is used, annual interest will be charged on the whole purchase price for the entire payment period from the sale date to the end of the payment period in accordance with section 3(2) of the Interest Act.

Appeals: An enforcement appeal against the sale and any act related to or preceding the sale must be filed within three weeks from the sale. Instructions on how to appeal are attached to the sale decision.

Terms of sale:

The property is seized and will be sold privately by the enforcement officer in accordance with section 76 of chapter 5 of the Enforcement Code and the general auction conditions of the Enforcement Code. The enforcement officer may accept or reject the highest bid in the auction. More information is available in the sales prospectus.

See the sales prospectus for information on any loan shares, unpaid company charges and other obligations or costs that the new owner is also liable to pay to obtain possession of the apartment share.
