TERMS OF SALE

Offers must be submitted by the stated deadline. Bids placed in the auction are binding. The highest bid is the bid that the seller has accepted as highest. By placing a bid, the bidder accepts these terms.

The property is sold by agreement between users. Huutokaupat.com is not a party to the sale. Bidders agree that their contact details may be disclosed by Huutokaupat.com to the seller to enable notification of the sale decision.

The buyer of the property will, as a rule, be the person who has made the highest accepted online auction bid. The Municipality of Myrskylä is not responsible for the functioning of the service provider's system.

The property is sold with its buildings to the winner of the tender in the condition and with the equipment shown in the sales notice and at the time of sale, except for items marked as belonging to the seller.

The property may only be sold to the highest bidder registered in the huutokaupat.com system. If the highest binding bidder places an unjustified bid, they must pay the seller a penalty fee within 3 days equal to 20% of the auction price or at least EUR 3,000. If, during the verification stage, it is determined that the bid will not be accepted, no penalty will be charged.

By submitting a bid the bidder accepts the condition of the property as is.

Descriptions in the sales notice are only the seller's estimates of the property.

Areas have not been re-measured. The purchase price is not based on the building's or property's area.

Bidders agree to provide the seller with a statement clearly describing the intended use of the building, the planned functions and any proposed repair or modification measures. The seller has the right to request and the bidder is obliged to provide additional information required before the sale is accepted.

The competent authority of the Municipality of Myrskylä reserves the right to accept or reject the highest bid. The final highest offered purchase price requires a sales decision made in accordance with the municipality's administrative rules as soon as possible, subject to any required meeting procedures.

If the sales decision is negative, the bidder has no right to compensation for the cancellation of the property sale. Buyers from outside the EU and EEA require a separate permit for real estate transactions.

The final real estate sale will be made in the form required by the Land Code, using the deed prepared by the seller and under the terms stated by the seller.

The purchase price must be paid to the seller before signing the deed.

The seller will hand over documents relating to the property no earlier than at the deed-signing event.

WITHDRAWAL FROM THE REAL ESTATE TRANSACTION

The seller has the right to withdraw from concluding the final real estate transaction at any time if the sale has not been carried out in the form required by the Land Code.

If the buyer notifies that they withdraw from the transaction after the seller or the seller's representative has confirmed acceptance of the offer, the seller will require compensation from the buyer for the presentation of the property and the preparation of the transaction.

INSPECTION OF THE PROPERTY

The bidder is obliged, before submitting an offer, to inspect the property, documents and records. The buyer cannot later rely on a matter that could have been observed during a prior inspection.

The buyer cannot subsequently claim a defect in the quality of the property that was disclosed in the sales material or could have been clearly observed at the viewing. If the defect is a latent defect, the buyer is not entitled to compensation for other damages, such as costs of investigating the defect or interest costs on loans taken for repairs. A latent defect means a defect the seller was not aware of and could not reasonably have been expected to know.

INFORMATION PROVIDED BY THE SELLER

The Municipality of Myrskylä confirms that it has provided the buyer with all information that the seller knows and that can be assumed to affect the sale.

CONCLUSION OF SALE AND PAYMENT

The real estate transaction must be made in the form required by the Land Code.

All payments and contractual documents are to be made with the Municipality of Myrskylä.

The deed used in the transaction will be the deed prepared by the seller.

The time and place for signing the deed will be agreed with the buyer separately.

The purchase price is paid by bank transfer to the account specified by the seller before signing the deed.

The buyer is responsible for the fee of the person who certifies the sale or for the service fee of the National Land Survey's property exchange service.

The buyer is responsible for the transfer tax on the real estate transaction.

The buyer shall apply for title registration within the statutory time limit from the signing of the deed and pay the title registration costs.

The Municipality of Myrskylä is responsible for taxes and other public-law charges related to the property up to the transfer of ownership. The buyer is responsible for such taxes and charges after the transfer of ownership.

The State has a pre-emptive right in the sale of real estate if acquisition is needed for national defence, border control or border security, or to ensure or safeguard territorial integrity (Act on the State's pre-emption right in certain areas 29 March 2019/469).

Persons outside the EU and EEA may acquire real estate in Finland only if a permit is granted (Act on the Supervision of Certain Acquisitions of Real Property 29 March 2019/470). The buyer is responsible for obtaining the permit and any obligations arising from it. More information is available on the Ministry of Defence website.
