Acceptance of the property sale and signing of the deed:

The seller does not accept conditional offers.

The seller may, at its discretion, extend the deadline for submitting offers.

The seller reserves the right to accept or reject the highest offer.

Bidders agree that their contact details may be disclosed by Huutokaupat.com to the seller to enable the sales decision and related notifications.

The buyer of the property will, as a rule, be the person who made the highest accepted bid in the online auction. The seller is not responsible for the functionality of the service provider's system.

If the online auction buyer makes an offer on behalf of another person, the bidder must immediately provide authorisation and the actual buyer's details by e-mail after the highest accepted bid. Otherwise the City of Orimattila will make the sale decision in favour of the party that submitted the highest accepted bid.

The property is sold with buildings to the winner of the bidding in the condition and with the equipment as described in the sales listing and present at the time of sale, excluding items marked as belonging to the seller.

The property may only be sold to the highest bidder recorded in the Huutokaupat.com system.

By placing a bid the bidder accepts the condition of the property as is.

The descriptions in the sales listing are solely the seller's assessments of the property.

Areas have not been re-measured. The purchase price is not based on the building's or property's area.

Note! The competent authority of the City of Orimattila reserves the right to accept or reject the highest bid. The final highest offered purchase price requires a sales decision made in accordance with the city's administrative rules as soon as possible, but possibly subject to necessary meeting procedures.

If the sales decision is negative, the bidder has no right to compensation for the cancellation of the property sale. Buyers from outside the EU and EEA require a separate permit for property acquisitions.

The final property transaction will be made in the form required by the Land Code, using the deed prepared by the seller and according to the seller's stated terms.

The purchase price must be paid to the seller before signing the deed.

The seller will hand over the keys and property-related documents no earlier than at the signing of the deed.

Withdrawal from the property transaction:

The seller has the right to withdraw from the final property transaction at any time if the sale has not been made in the form required by the Land Code.

If the buyer notifies withdrawal from the transaction after the seller or the seller's representative has confirmed acceptance of the offer, the seller will claim compensation from the buyer for the presentation of the property and preparation for the sale.

Viewing the property

The bidder is obliged, before making an offer, to inspect the property and its documents. The buyer may not subsequently rely on a matter that could have been observed at the preliminary inspection.

Defects and complaints:

The buyer may not subsequently rely on a defect in the quality of the property that was apparent in the sales material or could have been clearly observed during the viewing. If there is a hidden defect in the property, the buyer shall not be entitled to compensation for other losses, such as the costs of investigating the defect or interest costs on loans taken for repairs. A hidden defect means a defect the seller was not aware of and could not reasonably have been expected to know.

Information provided by the seller:

The seller warrants that it has given the buyer all information that the seller knows and that can be expected to affect the sale.

Completion of sale and payments:

The property sale must be made in the form prescribed by the Land Code.

All payments and deeds are handled with the City of Orimattila's Economic Development department.

The deed drafted by the seller will be used in completion of the sale.

The time and place for signing the deed will be agreed separately with the buyer.

Payment of the purchase price is made by bank transfer to the account specified by the seller before signing the deed.

The buyer is responsible for the fee of the confirming officer or the National Land Survey's property exchange service charge.

The buyer is responsible for the transfer tax arising from the property transaction.

The buyer shall apply for title registration within the time prescribed by law from signing the deed and pay the title registration costs.

The seller is responsible for taxes and other public charges payable in respect of the property until ownership is transferred to the buyer. The buyer is responsible for such taxes and charges after ownership has transferred.

Sales terms

The seller reserves the right to accept or reject the highest offer.

The property is sold as a transaction between users. Huutokaupat.com is not a party to the sale.

Bids must be submitted by the stated deadline. The highest bid is the one the seller has accepted as highest. By bidding the bidder accepts these terms.

The City of Orimattila warrants that it has given the buyer all information that the seller knows and that can be expected to affect the sale.

The State has a pre-emptive right to acquire the property if acquisition is necessary for national defence, border control or border security or for safeguarding territorial integrity (Act on the State's Pre-emptive Right in Certain Areas, 29 March 2019/469).

Persons from outside the EU and EEA may acquire property in the territory of Finland only if a permit is granted (Act on the Permit Requirement for Certain Acquisitions of Real Estate, 29 March 2019/470). The buyer is responsible for obtaining the permit and related obligations. More information is available on the Ministry of Defence website.

Execution of the sale

The property sale must be made in the form required by the Land Code. The time and place for signing the deed will be agreed separately with the buyer. Payment of the purchase price takes place at the signing. The buyer pays the confirming officer's fee.

Withdrawal from the sale

A party who refuses to complete the sale must, under the Land Code, compensate the other party for reasonable costs incurred for advertising, inspecting the property and other necessary acts related to the completion of the sale.
