The National Enforcement Authority Finland is not responsible for the functioning of the service provider’s system. Bids submitted in the online auction are binding. If a bid is accepted, the bidder is obliged to pay the offered purchase price within the agreed payment period. Failure to pay the offered purchase price may result in the buyer’s liability for compensation under Chapter 5, section 25 of the Enforcement Code.

If it is not possible to submit a bid through the Huutokaupat.com service, a prospective buyer may submit a written bid to the enforcement officer, which will be added to the online auction as a maximum bid under the automatic bidding system. However, the enforcement officer may not accept the highest bid if, in the officer’s assessment, the bid is clearly below the property’s fair local market value.

Payment terms:

The buyer must immediately pay 20% of the purchase price as a deposit into the National Enforcement Authority Finland’s official account. The deposit cannot be paid by credit card. The National Enforcement Authority Finland will contact the highest bidder whose bid has been accepted. If necessary, a payment period of no more than six weeks may be granted for the balance of the purchase price. Use of the payment period must be agreed separately. If the payment period is used, annual interest in accordance with section 3(2) of the Interest Act must be paid on the entire purchase price for the full agreed payment period, from the date of sale until the end of the payment period. The interest under section 3(2) of the Interest Act is currently 2.5%.

Other information:
The property has been distrained and is sold by a sale conducted by the enforcement officer, applying, where appropriate, the general auction terms laid down in the Enforcement Code.

Prospective buyers are advised to familiarise themselves thoroughly with the property for sale, the sales brochure and the attached documents. The sales brochure is indicative and is not a comprehensive description of the property for sale. Buyers should therefore inspect the property before submitting a bid.

The buyer is liable to pay transfer tax of 1.5%. The tax is calculated on the total of the purchase price and the liabilities transferred to the buyer, based on the date on which ownership is transferred.

The buyer obtains ownership of the shares, and the deed of sale is handed over to the buyer only once the sale decision has become legally binding and the purchase price and transfer tax have been paid in full.
