The enforcement authority reserves the right to end the sale or extend the sale period.
The buyer must immediately pay a deposit of 20 per cent of the purchase price into the Enforcement Authority’s official funds account. The deposit cannot be paid by credit card. The Enforcement Authority will contact the bidder with the highest accepted bid. The bidder with the highest bid must state on whose behalf the bid was made. Otherwise, the bidder with the highest bid is deemed to be the buyer.
If necessary, up to six weeks’ payment time may be granted for the remaining purchase price. Payment terms must be agreed separately. If payment time is used, annual interest on the entire purchase price must be paid in accordance with section 3(2) of the Interest Act for the whole agreed payment period from the date of sale until the end of the payment period.
If payment time is not used, the purchase price must be paid without delay after acceptance of the bid.
If payment is not made within the set time, the buyer must pay default interest on the entire purchase price in accordance with section 4(1) of the Interest Act until the purchase price has been paid or a new sale has been held.
If the debtor uses the premises sold or keeps property there, the buyer has the right to request official assistance from the enforcement officer to carry out eviction after the purchase price has been paid. The eviction shall, where applicable, follow the provisions of the Enforcement Code on eviction. The moving-out date shall be set so that, unless there is a weighty reason, it is not earlier than one week or later than two weeks from the date on which the move-out notice was served.
In eviction proceedings, the buyer may be authorised to deal with movable property of little or no value as they wish. The buyer must be prepared to bear any costs arising from enforcement of the eviction. In practice, if movable property has been left at the site, the cleaning of the property and disposal of the movable property will be carried out at the buyer’s expense.
The buyer acquires the right to possess the property when the full purchase price has been paid and any eviction has been carried out. The buyer may not use the property in a way that reduces its value before receiving the deed of sale. The buyer acquires ownership of the property upon receipt of the deed of sale. The deed of sale will be handed over when the full purchase price has been paid and the sale has become final.
The State has a right of pre-emption in the sale of real property if the acquisition of the property is necessary for national defence, border control or border security, or for monitoring or safeguarding territorial integrity (Act on the State’s Right of Pre-emption in Certain Areas 29 March 2019/469).
Persons outside the EU and EEA may acquire real property in Finland only if a permit is granted for the acquisition (Act on the Permit Requirement for Certain Real Estate Acquisitions 29 March 2019/470).
