Enforcement-seized apartment shares in Kouvola will be sold by online auction on Huutokaupat.com from 29 October to 19 November 2026 at 12:00. Each new bid extends the closing time by two minutes.

Terms of Sale

The property will be sold by ascending bids in an online auction held on www.huutokaupat.com between 29 October and 19 November 2026. Participation in the auction requires registration. The deadline for bids is 19 November 2026 at 12:00 or two minutes after the last accepted bid.

The National Enforcement Authority Finland is not responsible for the functionality of the service provider’s system. The highest bid is the bid that the service provider’s system has accepted as the highest. The enforcement officer will separately decide whether to accept or reject the highest bid.

Bids submitted in the online auction are binding. If a bid is accepted, the bidder must pay the offered purchase price within the stated payment period. Failure to pay the offered purchase price may result in the buyer’s liability for compensation under Chapter 5, section 25 of the Enforcement Code.

If it is not possible to submit purchase bids through the Huutokaupat.com service, a prospective buyer may submit a written purchase bid to the enforcement authority, which will be included in the online auction as a maximum bid in accordance with the bidding agent. The written bid must be signed and state the bidder’s contact details, maximum bid and the Huutokaupat.com item number concerned. A written purchase bid is binding and is subject to the same terms as an online auction bid. The bid must be submitted by 18 November 2026 at 10:00 to the National Enforcement Authority Finland’s Kouvola office, address Vuorikatu 1, 45100 Kouvola, OR by email to kouvola.realisointi.uo@oikeus.fi.

The enforcement authority reserves the right to end the sale or extend the bidding period.

The buyer must immediately pay a deposit of 20% of the purchase price into the National Enforcement Authority Finland’s official funds account. The deposit cannot be paid by credit card. The National Enforcement Authority Finland will contact the bidder whose highest bid has been accepted. The highest bidder must state on whose behalf the bid was made. Otherwise, the highest bidder will be deemed the buyer.

Up to six weeks may be granted for payment of the balance of the purchase price, if necessary. The payment period must be notified separately. If a payment period is used, annual interest in accordance with section 3(2) of the Interest Act must be paid on the entire purchase price for the agreed payment period, from the date of sale until the end of the payment period.

If no payment period is used, the purchase price must be paid without delay after acceptance of the bid. If payment is not made within the prescribed period, the buyer must pay default interest in accordance with section 4(1) of the Interest Act on the entire purchase price until the price has been paid or a new sale has been conducted. The current default interest rate is 9.50%.

Liabilities transferred to the buyer due to the previous owner’s failure to pay charges and fees

According to the property manager’s certificate dated 6 October 2026, unpaid maintenance charges and equivalent arrears, together with other receivables of the housing company, total €5,505.92 as at 30 September 2026.

The apartment was taken into the housing company’s possession on 31 July 2024, and the possession period ends on 31 July 2027. The housing company has rented the apartment from 16 October 2026. As the apartment has been taken into the company’s possession, the new owner has the right under the Limited Liability Housing Companies Act to obtain possession before the end of the possession period after paying, with interest, all costs arising from taking possession, costs incurred by the company for repairing the apartment and unpaid company charges, as well as charge instalments falling due for payment by the shareholder during the possession period (Limited Liability Housing Companies Act, Chapter 8, sections 7 and 6(2)).

Costs incurred by the company from taking possession:

Service costs charged by the District Court of Pohjois-Savo for the possession warning and possession decision, €85.00 each, totalling €170.00.

Fee charged to the housing company by Kouvolan Isännöintikolmio for handling the possession process, €434.00.

Total costs: €604.00.

If the buyer does not pay the housing company’s receivables in full, the company’s possession decision will bind the buyer and the housing company will continue renting out the apartment to cover its receivables. The buyer’s personal liability for charge arrears incurred during the previous owner’s ownership is then determined under Chapter 3, section 7 of the Limited Liability Housing Companies Act. The new owner is jointly and severally liable with the previous owner for company charges neglected by the previous owner and for other payments referred to in Chapter 3, section 2(2) of the Act. The maximum liability equals the company charge for the month in which ownership was transferred and the five immediately preceding months.

The amount of the receivables referred to above changes monthly, and default interest also accrues on overdue receivables.

The housing company has rented the apartment from 16 October 2026. The tenancy is valid until further notice. The rent is €500 per month; the tenant pays the water charge according to consumption. Under Chapter 8, section 6 of the Limited Liability Housing Companies Act, the tenant’s right to possess the apartment ends without notice no later than when the company’s possession period ends, regardless of the agreed tenancy term. The tenancy’s binding effect on the owner of the apartment is determined under Chapter 5, section 39 of the Act on Residential Leases. This tenancy binds the new owner and cannot be terminated on the grounds that the shares were sold in a sale conducted by an enforcement officer. If the buyer pays the company’s overdue receivables relating to the apartment, the buyer will automatically become the landlord in place of the company, with the tenancy continuing on its existing terms. Under Chapter 7, section 52 of the Act on Residential Leases, the tenant’s notice period is one month. The landlord’s notice period is three months if the tenancy has lasted less than two years. The notice period begins on the last day of the calendar month in which the notice of termination was received.

NOTE! None of the housing company’s receivables encumbering the apartment for sale will be paid from the purchase price. The purchase price is therefore not a so-called debt-free price. The buyer must itself ensure payment to the housing company of the obligations relating to the apartment for which it is responsible. Bids in the online auction must take these matters into account.

In addition to the purchase price payable in money, the buyer will assume the apartment’s share of the housing company loan, €8,774.46 as at 30 September 2026. The apartment’s share of the housing company loan remains payable by the buyer and will not be paid from the purchase price. The buyer must itself ensure payment to the housing company of the obligations relating to the apartment for which it is responsible. Bids in the online auction must take these matters into account.

The buyer must pay transfer tax of 1.5%. The tax is calculated on the combined total of the purchase price and the obligations transferred to the buyer, as at the date ownership is transferred.

The buyer obtains the right of possession of the property sold when the entire purchase price and the obligations transferred to the buyer have been paid. The buyer may not use the property in a way that reduces its value before receiving the deed of sale. In addition, obtaining possession of the apartment requires fulfilment of the conditions in Chapter 8, section 7 of the Limited Liability Housing Companies Act. The buyer obtains title to the property sold upon receiving the deed of sale. The deed of sale will be handed over once the sale has become final and the full purchase price and transfer tax have been paid.

The housing company has transferred the register of shares to the Residential and Commercial Property Information System maintained by the National Land Survey of Finland. The buyer must apply to register ownership within two months of the date of the deed of sale. The National Land Survey of Finland will cancel the paper share certificate when ownership is registered. The buyer is responsible for the registration costs.

The property has been seized and will be sold by a free sale conducted by the enforcement officer, applying as appropriate the general auction terms laid down in the Enforcement Code. The sales brochure is indicative and is not a comprehensive description of the property sold. Buyers are urged to carefully familiarise themselves with the property, the sales brochure and the attached documents before submitting a bid.
