Terms of Sale

The lot is sold in an online auction on the website www.huutokaupat.com during 15 April–8 May 2026. Participation requires registration. The deadline for placing bids ends on 8 May 2026 at 13:00 or 3 minutes after the last accepted bid.


The Enforcement Authority is not responsible for the service provider’s system. The highest bid is the bid that the service provider’s system has recorded as highest. The enforcement officer decides whether to accept or reject the highest bid. Bids made in the online auction are binding. If a bid is accepted, the bidder is obliged to pay the offered purchase price within the agreed payment period. Failure to pay the offered purchase price may lead to the buyer’s liability for compensation under Chapter 5, Section 25 of the Enforcement Code.


The Enforcement Authority reserves the right to end the sale or extend the sale period.


The property has been seized and is sold by private sale under the supervision of the enforcement officer in accordance with Chapter 5, Section 76 of the Enforcement Code and, where applicable, the general auction terms set out in the Enforcement Code.


Payment terms


The enforcement officer will notify the highest bidder whether the bid can be accepted. If the bid can be accepted, the buyer pays the full purchase price by bank transfer to the Enforcement Authority’s official trust account. When the payment is visible on the trust account, the enforcement officer issues the sale decision which will be delivered to the parties. The purchase price cannot be paid by credit card.


Deposit: If the whole purchase price is not paid immediately, the buyer must pay a deposit of 20% of the purchase price immediately.


Payment period: If necessary, up to six weeks’ payment time may be granted for the remaining purchase price from the sale decision. In that case annual interest is payable on the whole purchase price for the entire payment period from the date of sale until the end of the payment period. The reference rate is currently 2.50%. If payment is not made within the granted period, annual default interest will be charged thereafter, currently 9.50%.


Buyer’s liabilities that transfer with the property


The buyer must pay the transfer tax, which is 1.50% of the total of the purchase price and any unpaid company receivables, charges and the housing company loan share relating to the flat. The transfer tax is paid to the tax authority. The buyer must provide proof of payment of the transfer tax before the share certificate is handed over and the deed is issued.


The housing company has transferred its share register to the apartment information system maintained by the National Land Survey of Finland. The buyer must apply to register ownership within two months of the date of the deed. The National Land Survey will cancel the paper share certificate when ownership is registered. The buyer pays the registration costs.


The flat has been taken into the company’s possession for three years by a general meeting decision dated 16 May 2024. The possession decision gives the housing company the right to rent out the flat to cover arrears in charges and other payments. Under the Housing Companies Act (Chapter 8, Section 7), the new owner of the sold shares will receive possession of the flat when they have paid to the company all amounts due which could be covered by rent from the flat under Chapter 8, Section 6(2) of the Housing Companies Act. These amounts consist of unpaid company charges and other payments forming the basis for the company’s possession and of those charge items and other payments that fall due during the period of possession. According to the property manager, unpaid company charges amount to €6,468.91 as at 31 March 2026.


The amount of the claim changes monthly. The buyer must ascertain the arrears in charges and pay them directly to the housing company. These are not to be paid from the purchase price payable to the Enforcement Authority.


In addition to the cash purchase price, the buyer takes over a share of the company’s loans, which according to the property manager total €8,426.43 as at 30 March 2026. Water-pipe renovation €2,023.77, paid to the housing company as a capital charge of €47.02/month, and sewer renovation €6,402.66, paid as a capital charge of €77.29/month. The sewer renovation capital charge is currently indicative and will be confirmed later according to the instalment schedule. Charging is expected from May 2026 onwards. The housing company loan share relating to the flat remains payable by the buyer and is not paid from the purchase price.


The buyer is responsible for ensuring that obligations related to the flat that are their responsibility are fulfilled to the housing company. Bids made in the online auction should be sized taking these matters into account.


If it is not possible to place bids via the Huutokaupat.com service, a prospective buyer may submit a written bid to the enforcement officer. The bid will be entered into the online auction as a maximum bid according to the incrementing system. The written bid must be submitted in writing to the Enforcement Authority no later than 7 May 2026 at 12:00 to the address: Enforcement Authority / Kemi office, Valtakatu 28, 4th floor, 94100 Kemi. A written bid is binding and the same terms as the online auction apply. The written bid must be signed and must include the bidder’s contact details, the bid’s maximum amount and the lot number in the Huutokaupat.com service to which the bid relates.
