1. Application

These are the auction terms that apply between Entrepot Trade Oy (the seller) and the buyer for all sales and/or purchase transactions of items offered for sale by the seller, unless otherwise agreed. The seller reserves the right to change these terms. Each sale/purchase is governed by the auction terms in force at the time of the auction end or the contract date. By participating in an auction on huutokaupat.com, the buyer is taken to have read, understood and accepted these terms. By placing a bid, the buyer agrees to comply with these terms. If the buyer does not accept these terms, they should not place a bid.

2. Buyer’s responsibility

By placing a bid the buyer commits to buying the item. The buyer is responsible for all bids placed using their huutokaupat.com account or by written offer when participating in seller-run auctions. The buyer is responsible for their account details and for any misuse and resulting costs.

3. Condition of auction items and inspection

Items offered for auction are described by the seller in good faith. Estimates are given by the seller. Items are sold in the condition and with the equipment they have at the time of the auction. The seller is not liable for the condition of the item or its suitability for its original purpose. The item is sold "as is" under Section 19 of the Sale of Goods Act. The buyer must inspect the item carefully and has no right to cancel the sale.

The buyer must inspect and familiarise themselves with the item before making a binding bid or written offer. The seller provides opportunity for inspection before the auction.

4. Participation in the auction

Participation takes place virtually at huutokaupat.com during the bidding period shown in the listing, or by submitting a written offer to the seller: Riihontie 162, 63610 Tuuri or by email to topias.riiho@gmail.com. The written offer must include the buyer’s full details and the bid price excl. VAT. Written offers must be submitted at least 3 hours before the stated auction end time.

5. Acceptance/rejection of bids

The seller reserves the right to accept or reject the highest bid unless stated otherwise in the listing.

The seller must notify acceptance or rejection of the bid within 3 (three) working days of the auction end.

6. Payment methods

Online bank transfer. Banks: Nordea, Danske Bank, Osuuspankki, S-pankki, Aktia, Tapiola Bank, Handelsbanken, Ålandsbanken, POP Bank, Savings Bank
(Or for amounts over €50,000, invoice/bank transfer)

Payment terms: 2 (two) days net.

Default interest is charged in accordance with Section 4, paragraph 1 of the Interest Act until the purchase price has been paid in full.

7. Price

The hammer price is exclusive of VAT; the applicable VAT will always be added unless otherwise stated.

8. Liability

Items are sold in the condition they are in at the time of auction. Full responsibility for the items transfers to the highest bidder immediately when the highest bid is accepted. Items must not be moved from the seller’s stated location before full payment of the purchase price.

The seller gives no warranty and no right of exchange or return for the sold items.

9. Transfer of ownership and risk

The buyer acquires ownership and the right to dispose of the purchased property when the purchase price has been paid in full.

10. Collection of items

The buyer is responsible for collecting and transporting the items. If the buyer orders a carrier to collect the purchased item, the buyer must notify the seller in advance. The seller hands over items against payment confirmation and/or receipt. If packing and delivery have been ordered/paid for, the goods will be delivered by the seller.

All successfully bid items must be removed within 7 (seven) days of the auction end unless otherwise agreed with the seller. The seller may charge rent for reserved space beyond 7 (seven) days at a reasonable daily rate. If items are not collected within 3 (three) months, the seller reserves the right to apply the Act on the Trader’s Right to Sell Uncollected Goods (15 July 1988/688).

11. Additional costs

The seller reserves the right to charge recovery costs and any other additional costs and/or costs incurred to third parties to the buyer.

12. Withdrawal from a bid

If the buyer withdraws from an accepted bid with the seller’s consent, the buyer must reimburse the seller for costs incurred in arranging the failed auction (27 March 1987/355 and 5 January 1994/16). Compensation for cancelling a binding sale is 10% of the purchase price, but at least €100. Compensation is an item not subject to VAT under VAT law.

13. Validity of the auction terms

These auction terms entered into force on 17 May 2015 and replace previous terms in force.
