Offers must be made by the stated deadline. The highest bid is the offer the seller has accepted as the highest. You may also participate in the auction in person by making an offer directly to the seller. The seller and buyer commit to recording all offers in the system. By making a bid the bidder accepts these terms of sale.

The seller commits to selling the item to the highest bidder. The seller warrants that they have given the buyer all information they know and that can reasonably be expected to affect the sale.

The item is sold as a private sale between users. Huutokaupat.com is not a party to the sale.

General auction terms of sale:

1. Application

These auction terms apply between Suunnittelu- ja rakennuspalvelu JK Oy (the seller) and the buyer to all sales and purchase transactions of products offered by the seller, whether by the seller or on behalf of a third party, unless otherwise agreed. Suunnittelu- ja rakennuspalvelu JK Oy reserves the right to amend these auction terms. Each sale and/or purchase is governed by the auction terms in force at the time of the auction end or the date of sale. Suunnittelu- ja rakennuspalvelu JK Oy requires that by participating in the auction on the huutokaupat.com site, the buyer has read, understood and accepted these auction terms. By submitting a bid on an item, the buyer agrees to comply with these auction terms. If the buyer does not agree to these terms, they should not place a bid.

2. Buyer’s responsibility

By placing a bid the buyer commits to purchasing the item. The buyer is responsible for all bids made using credentials received from the huutokaupat.com site or by written offer when participating in auctions managed by the seller. The buyer is responsible for their huutokaupat.com account details and any misuse of them and any costs that may arise.

3. Condition of auction items and inspection

Auction items have been described by the seller in good faith. Estimates are given by the seller. Items are sold in the condition and with the equipment they have at the time of auction. The item is sold in accordance with section 19 of the Sale of Goods Act “as is”. The buyer must inspect the item carefully and has no right to cancel the sale. The buyer must inspect and familiarise themself with the item before making a binding bid or written offer and assess the item on which their bid is based. The seller will provide the opportunity to inspect the item before the auction.

4. Participation in the auction

Participation in the seller’s auction takes place virtually at huutokaupat.com during the bidding period stated in the auction notice and on site at the building’s location.

5. Acceptance/rejection of bids

Suunnittelu- ja rakennuspalvelu JK Oy reserves the right to accept or reject the highest bid unless otherwise stated in the notice.

Suunnittelu- ja rakennuspalvelu JK Oy shall notify acceptance or rejection of the bid within 2 (two) working days of the auction closing.

6. Payment methods

Online bank payment. Banks: Nordea, Danske Bank, Osuuspankki, S-pankki, Aktia, Tapiola Bank, Handelsbanken, Ålandsbanken, Pop Bank, Savings Bank
(Or if the amount exceeds €50,000: invoice/bank transfer)

Payment term: 2 (two) days net.

Late payment interest follows the Interest Act, section 4(1), until the purchase price is paid in full.

7. Price

The auction price is the price inclusive of VAT, i.e. it includes the applicable value added tax unless otherwise stated.

8. Liability

Items are sold in the condition they are in at the time of auction. Full liability for the items transfers to the highest bidder immediately when the highest bid is accepted. Items may not be moved from the seller’s stated location before the purchase price has been paid in full.

Suunnittelu- ja rakennuspalvelu JK Oy gives no warranty and no right of exchange or return for the items sold.

9. Transfer of ownership and control

The buyer obtains ownership and the right to dispose of the purchased property from the seller by auction and/or otherwise once the purchase price has been paid in full.

10. Collection of items

The buyer is responsible for removing purchased items. If the buyer arranges a carrier to collect the purchased item, the buyer must notify the seller in advance. Suunnittelu- ja rakennuspalvelu JK Oy will release items only upon receipt of payment confirmation and/or a receipt. If packing and delivery have been ordered/paid for, the goods will be delivered by the seller.

All successfully auctioned items must be removed within 7 (seven) days of the auction end, unless otherwise agreed with the seller. The seller has the right to charge rent for the space reserved by the sold item, indoors and/or outdoors, for any period exceeding 7 (seven) days at a reasonable daily rate. If items are not collected within 3 (three) months, the seller reserves the right to apply the Act on the Right of an Entrepreneur to Sell an Uncollected Item (15/07/1988/688).

11. Additional costs

Suunnittelu- ja rakennuspalvelu JK Oy reserves the right to charge collection costs and any other additional costs and/or costs incurred to a third party to the buyer.

12. Withdrawal from a bid

If the buyer withdraws from an accepted bid with the seller’s consent, the buyer must compensate the seller for costs incurred in organising the failed auction (27/03/1987/355 and 05/01/1994/16). The compensation for cancelling a binding sale is 10% of the sale price, but at least €100. The compensation is, under VAT law, an item not subject to value added tax.
