Viewing the property

The descriptions in the listing are only the seller's estimates of the property for sale. Before making an offer, the bidder is obliged to inspect the property, documents and records. The buyer may not later rely on any matter that could have been observed during a prior inspection. Anyone participating in the auction must inspect the property before making a binding offer. By submitting an offer the bidder accepts the condition of the property as is. The buyer accepts electronic delivery of notices.

Information provided by the seller

Lahden Tilakeskus warrants that it has provided the buyer with all information that the seller knows and that can be expected to affect the sale.

Conclusion of the sale

The time and place for signing the deed will be agreed with the buyer separately. At the signing the buyer shall present a receipt for the paid purchase price. Ownership of the property transfers to the buyer after signing the deed and paying the purchase price. The deed must be signed within one month of the decision on the sale by the competent authority becoming legally binding.

Other costs

The buyer is responsible for transfer tax at the rate in force at the time of the transaction.

Withdrawal from the sale

If a bidder withdraws from an accepted bid, they shall compensate the seller for costs incurred from the failed auction amounting to 4% of the purchase price.

Sanctions

The parties to the sale warrant that they will comply with trade, economic or financial sanctions, embargoes or similar restrictive measures imposed by sanctions authorities. The parties warrant that neither they nor any of their direct or indirect subsidiaries or affiliates, nor their beneficial owners, members of their boards or other senior officers, are subject to sanctions or otherwise in breach of applicable sanctions.

If the above warranty by a party proves to be untrue or incorrect, that party shall notify the other party without delay upon becoming aware of the breach. In addition to other remedies, the non-breaching party shall be entitled to rescind the sale and to recover from the party that breached the warranty all damages, costs and losses resulting from the breach.

For the purposes of this agreement, sanctions authorities mean the following bodies, their agencies, institutions or offices:

The United Nations Security Council; the European Union; the United Kingdom; and the United States (including the US Department of the Treasury’s Office of Foreign Assets Control (OFAC)).
