Terms of Sale

How bids are submitted

The property is sold by ascending bids in an online auction held on www.huutokaupat.com from 28/10/2026 to 29/11/2026. Registration is required to participate.

The deadline for bids is 29/11/2026 at 18:00, or two minutes after the last accepted bid.

The Enforcement Authority is not responsible for the service provider's system functioning. The highest bid is the bid that the service provider's system has accepted as the highest. The enforcement officer will separately decide whether to accept or reject the highest bid.

If it is not possible to submit bids through Huutokaupat.com, a prospective buyer may submit a written purchase offer to the enforcement authority. It will be included in the online auction as the maximum bid in accordance with the automatic bidding function. The written offer must be signed and state the bidder's contact details, maximum amount and the lot number on Huutokaupat.com to which it relates. The written purchase offer is binding and subject to the same terms as the online auction. The offer must be submitted by 25/11/2026 at 12:00 to the Lahti office of the Enforcement Authority, Kirkkokatu 12, 15140 Lahti, or by email to lahti.realisointi.uo@oikeus.fi.

The enforcement authority reserves the right to end the sale or extend the sale period.

Buyer's liability for compensation

Bids submitted in the online auction are binding. If a bid is accepted, the bidder must pay the offered purchase price within the stated payment period. Failure to pay the offered purchase price may result in the buyer's liability for compensation under Chapter 5, section 25 of the Enforcement Code.

After the auction ends, the enforcement officer will notify the highest bidder whether the bid has been accepted or rejected.

Payment terms

Deposit

The buyer must immediately pay 20% of the purchase price as a deposit to the Enforcement Authority's official funds account. The deposit cannot be paid by credit card. The Enforcement Authority will contact the highest bidder whose bid has been accepted.

The highest bidder must state on whose behalf the bid was made. Otherwise, the highest bidder will be deemed the buyer.

Payment period

A payment period of up to six weeks may be granted for the balance of the purchase price where necessary. The payment period will be notified separately. If a payment period is used, annual interest under section 3(2) of the Interest Act must be paid on the entire purchase price for the agreed period, from the date of sale until the end of the payment period.

If no payment period is used, the purchase price must be paid without delay after acceptance of the bid.

If payment is not made within the prescribed period, the buyer must pay default interest under section 4(1) of the Interest Act on the entire purchase price until it has been paid or a new sale has taken place. The current default interest rate is 9.50%.

Obligations and rights transferred to the buyer

New owner's liability for certain obligations relating to the shares:

1. New owner's personal liability for the previous owner's unpaid charges and payments

Under Chapter 3, section 7 of the Housing Companies Act, the new owner is jointly and severally liable with the previous owner for the housing company's maintenance charges and other payments referred to in Chapter 3, section 2(2), which the previous owner failed to pay.

The maximum liability equals the total maintenance charges and payments for the month in which ownership transferred and the five immediately preceding months. However, the new owner is not liable for a maintenance charge or payment omitted by the former owner if it was not stated in the manager's certificate and became due before the certificate was dated.

The buyer is personally liable only up to the above maximum, which, according to the manager's certificate dated 08/10/2026, is €2,696.98.

According to the manager's certificate, more unpaid maintenance charges affect the flat. The housing company has not yet taken possession of the flat.

The situation may change during the sale procedure.

2. Significance of taking possession of the shares for the new owner

The residential flat was taken into the company's possession by a decision of the general meeting on 24/03/2026. As the flat has been taken into the company's possession, the new owner has the right under the Housing Companies Act to obtain possession before the possession period ends by paying, with interest, all costs arising from taking possession, costs incurred by the company for repairing the flat, unpaid maintenance charges and those charges falling due during the possession period (Housing Companies Act, Chapter 8, sections 7 and 6(2)). The current amount as at 20/10/2026, including all arrears of charges and payments and possession costs, is €6,321.22.

NOTE! The amount of the receivables stated above changes monthly, as new maintenance charges and payments relating to the flat fall due each month. Default interest also accrues on overdue receivables. Receivables of the housing company encumbering the flat for sale and the share of the housing-company loan are not paid from the purchase price in any respect. The purchase price is therefore not a so-called debt-free price. The buyer must themselves ensure payment to the housing company of the obligations relating to the flat for which they are responsible.

Bids made in the online auction must take these matters into account.

Transfer tax

The buyer must pay transfer tax of 1.5%. The tax is calculated on the total of the purchase price and the obligations transferred to the buyer, based on the date ownership transfers.

Transfer of possession and ownership

The buyer obtains the right of possession of the property for sale when the entire purchase price and any obligations transferred to the buyer have been paid. The buyer may not use the property in a way that reduces its value before receiving the deed of sale.

The buyer obtains ownership of the property for sale upon receiving the deed of sale. The deed is handed over once the sale is final and the entire purchase price and transfer tax have been paid.

Other information

The property has been seized and is sold by a free sale conducted by the enforcement officer, applying the general auction terms laid down in the Enforcement Code as appropriate.

The sales brochure is indicative and is not a comprehensive description of the property for sale.

Buyers are advised to carefully familiarise themselves with the property for sale, the sales brochure and the attached documents before bidding.
