1. Application

These are the auction terms applicable between Entrepot Trade Oy (the seller) and the buyer in all sales and/or purchase transactions for items offered for sale by the seller, unless otherwise agreed. The seller reserves the right to amend these auction terms. Each sale and/or purchase is governed by the auction terms in force at the time of the auction end or the date of sale. The seller requires that, by taking part in auctions on huutokaupat.com, the buyer has read, understood and accepted these terms. By placing a bid, the buyer agrees to comply with these terms. If the buyer does not accept these terms, they should not place a bid.

2. Buyer’s responsibility

By placing a bid the buyer commits to purchase the item. The buyer is responsible for all bids placed using the user credentials received from huutokaupat.com or by submitting a written offer to the seller. The buyer is responsible for their huutokaupat.com credentials and for any misuse and resulting costs.

3. Condition of auction items and inspection

Items for auction are described by the seller in good faith. Any estimates are provided by the seller. Auction items are sold in the condition and with the accessories they have at the time of auction. The seller is not responsible for the condition or suitability of the item for the original intended use. The item is sold, in accordance with Section 19 of the Sale of Goods Act, "as is." The buyer must inspect the item carefully and has no right to cancel the sale.

The buyer must examine and familiarise themselves with the item before making a binding bid or written offer. The seller provides an opportunity for inspection before the auction whenever possible.

4. Participation in the auction

Participation in the seller’s auction takes place virtually at huutokaupat.com during the bidding period stated in the auction listing, or by submitting a written offer to the seller at Riihontie 162, 63610 Tuuri or by email to topias.riiho@gmail.com. A written offer must show the buyer’s full details and the bid price excl. VAT. Written offers must be submitted no later than 3 hours before the stated auction end time.

5. Acceptance/rejection of bids

The seller reserves the right to accept or reject the highest bid, unless otherwise stated in the listing.

The seller will notify acceptance or rejection within 3 (three) working days of the auction end.

6. Payment methods

Online bank payment. Banks: Nordea, Danske Bank, OP, S-Pankki, Aktia, Tapiola Bank, Handelsbanken, Ålandsbanken, POP Bank, Savings Bank
(Or, for amounts exceeding €50,000, invoice/bank transfer)

Payment terms: 2 (two) days net.

Late payment interest is charged in accordance with Section 4(1) of the Finnish Interest Act until the purchase price is fully paid.

7. Price

The auction price is exclusive of VAT; the applicable value added tax will be added unless otherwise stated.

8. Liability

Items are sold in the condition they are at the time of auction. Full responsibility for the items passes to the highest bidder immediately when the highest bid is accepted. Items must not be removed from the seller’s stated location before full payment of the purchase price.

The seller gives no warranty and there is no right of exchange or return for goods sold.

9. Transfer of ownership and right of disposal

The buyer acquires ownership and the right to dispose of the purchased property when the purchase price has been paid in full.

10. Collection of items

The buyer is responsible for removing and transporting the items. If the buyer orders a carrier to collect the purchased item, the buyer must notify the seller in advance. The seller hands over items only against payment confirmation and/or receipt. If packing and delivery have been ordered/paid for, the goods will be delivered by the seller.

All successfully bid items must be removed within 7 (seven) days of the accepted auction end, unless otherwise agreed with the seller. The seller may charge rent for the floor area reserved by the accepted bid item, indoors and/or outdoors, for any period exceeding seven days at a reasonable daily rate. If bids are not collected within 3 (three) months, the seller reserves the right to apply the Act on the Right of an Entrepreneur to Sell an Unclaimed Item (15 July 1988/688).

11. Additional costs

The seller reserves the right to charge collection costs and any other additional costs incurred and/or costs incurred by third parties to the buyer.

12. Withdrawal from a bid

If the buyer withdraws from an accepted bid with the seller’s consent, the buyer must compensate the seller for costs incurred by arranging the failed auction (27 March 1987/355 and 5 January 1994/16). The compensation for withdrawal from a binding sale is 10% of the purchase price, but at least €100. Compensation is, under the VAT Act, an item on which VAT is not charged.

13. Validity of the auction terms

These auction terms came into force on 17 May 2015 and replace the previous terms.
