Terms of Sale

Method of submitting bids

The lot is sold by ascending bids in an online auction held on the website www.huutokaupat.com. Participation in the auction requires registration. The deadline for submitting bids ends on 17 February 2026 at 18:00 or three minutes after the last accepted bid.


The Enforcement Authority is not responsible for the functioning of the service provider’s system. The highest bid is the bid that the service provider’s system has accepted as the highest. The enforcement officer will separately decide whether to accept or reject the highest bid.


Bids placed in the online auction are binding. If a bid is accepted, the bidder is obliged to pay the offered purchase price within the agreed payment period. Failure to pay the offered purchase price may lead to the buyer’s liability to compensate under Chapter 5, Section 25 of the Enforcement Code.


If it is not possible to submit purchase bids via the Huutokaupat.com service, a prospective buyer may submit a written purchase bid to the enforcement authority, which will be attached to the online auction as a maximum bid according to the automatic increment. The written bid must be signed and must include the bidder’s contact details, the maximum amount of the bid and the Huutokaupat.com lot number to which the bid relates. The written purchase bid is binding and the same terms as in the online auction apply. Lowest acceptable bid

€1,558.40

The lowest acceptable bid includes enforcement costs and the sales fee. However, the enforcement officer must not accept the highest bid if, in the officer’s opinion, it clearly falls below the market value of the asset in the locality. The lowest acceptable bid does not represent the fair value of the lot and does not mean the lot will be sold at that price. In addition, a secured creditor as applicant has the right to prohibit the sale if their preferential claim is not covered by the sale proceeds.


Payment terms

Deposit

The buyer must immediately pay a deposit of 20% of the purchase price to the Enforcement Authority’s official account. The deposit cannot be paid by credit card. The Enforcement Authority will contact the maker of the highest bid if their bid is accepted. The highest bidder must state on whose behalf the bid was made; otherwise the highest bidder will be considered the buyer.


Payment period

If the highest bid is accepted, a payment period of up to six weeks may be granted if necessary. If no payment period is used, the purchase price must be paid immediately after acceptance of the bid. Any use of a payment period must be agreed separately. If a payment period is granted, annual interest will be charged on the full purchase price in accordance with section 3(2) of the Interest Act for the entire agreed payment period from the sale date until the end of the payment period.


If no payment period is used, the purchase price must be paid immediately after acceptance of the bid.


If payment is not made within the specified time, the buyer must pay late payment interest on the entire purchase price in accordance with section 4(1) of the Interest Act until the purchase price is paid or a new sale has taken place.


Obligations and rights transferred to the buyer and claims related to the property

Buyer’s personal liability for the previous owner’s arrears of charges and payments


Under the Housing Companies Act, the buyer is liable to the housing company (here the mutual real estate company) for the previous owner’s unpaid maintenance charges and usage fees, but only up to an amount equal to the sum of the maintenance charge for the month in which ownership transfers and the five months immediately preceding it.


According to the property manager’s certificate dated 17 October 2025, unpaid maintenance charges and usage fees totalling €713.95 were outstanding as at 15 October 2025. The buyer must ensure that obligations related to the flat that fall to them are paid to the housing company (once the buyer has obtained ownership). Bids in the online auction should take these matters into account.


Liability for new charges

Under section 6 of chapter 3 of the Housing Companies Act, the new owner is liable for new maintenance charges from the date ownership transfers.


Loan instalments of the housing company attributable to the flat

The buyer is responsible to the housing company for loan instalments attributable to the flat. According to the property manager’s certificate dated 17 October 2025, there are no loan instalments attributable to the flat.


Transfer tax

The buyer is obliged to pay transfer tax of 1.5%. The tax amount is calculated on the total of the purchase price and the obligations transferred to the buyer, with regard to the date of transfer of ownership.


Transfer of possession and ownership

The buyer acquires the right of possession under Chapter 5, Section 4 of the Enforcement Code when the purchase price has been paid in full, but must not use the property in a way that reduces its value before ownership of the shares has also been transferred.


The buyer acquires ownership of the lot when the purchase price has been paid in full, proof of payment of the transfer tax has been presented to the enforcement officer, the sale decision has become final and the enforcement officer has issued the buyer with the deed of sale.


After receiving the deed of sale, the buyer will submit the transfer tax return and provide proof of this to the enforcement officer. Thereafter the enforcement officer will hand over the share certificate with transfer endorsements to the buyer or a party designated by the buyer (e.g. the buyer’s bank).
