1. Application

These are the auction terms that apply between Entrepot Trade Oy (the seller) and the buyer in all sales and/or purchase transactions for items offered for sale by the seller or on the seller’s behalf, unless otherwise agreed. The seller reserves the right to amend these auction terms. Each sale and/or purchase transaction shall be governed by the auction terms in force at the time of the auction closing or contract date. By participating in an auction on huutokaupat.com the buyer is assumed to have read, understood and accepted these terms. By submitting a bid the buyer agrees to comply with these terms. If the buyer does not accept these terms, they should not place a bid.

2. Buyer’s responsibility

By placing a bid the buyer undertakes to purchase the item. The buyer is responsible for all bids placed using credentials obtained from huutokaupat.com or by written offer when participating in the seller’s auctions. The buyer is responsible for their user credentials on huutokaupat.com and for any misuse and resulting costs.

3. Condition of auction items and inspection

Auction items are described by the seller in good faith. Estimates are the seller’s opinions. Items are sold in the condition and with the accessories they have at the time of auction. The seller is not liable for the condition or suitability of the item for its original purpose. The item is sold “as is” in accordance with section 19 of the Sale of Goods Act. The buyer must inspect the item carefully; there is no right to cancel the sale afterwards.

The buyer must examine the item carefully before making a binding bid or written offer. The seller will provide an opportunity to inspect the item before the auction where possible.

4. Participation in the auction

Participation takes place virtually at huutokaupat.com during the bidding period stated in the auction notice, or by submitting a written offer to the seller: Riihontie 162, 63610 Tuuri or email: topias.riiho@gmail.com. Written offers must include the buyer’s full details and the bid price excl. VAT. A written offer must be submitted no later than 3 hours before the auction end time.

5. Acceptance/rejection of bids

The seller reserves the right to accept or reject the highest bid unless otherwise stated in the notice.

The seller will notify acceptance or rejection within 3 (three) business days of the auction closing.

6. Payment methods

Online banking. Banks: Nordea, Danske Bank, Osuuspankki, S-pankki, Aktia, Tapiola Bank, Handelsbanken, Ålandsbanken, POP Pankki, Säästöpankki
(Or if the sum exceeds €50,000: invoice / bank transfer)

Payment term: 2 (two) days net.

Late payment interest is charged in accordance with section 4(1) of the Interest Act until the purchase price is fully paid.

7. Price

The auction price is the net price; the applicable value added tax will be added unless stated otherwise.

8. Liability

Items are sold in the condition they are in at the time of auction. Full responsibility for the items transfers to the highest bidder immediately upon acceptance of the highest bid. Items may not be moved from the seller’s stated location before full payment.

The seller provides no warranty and no exchange or return right for sold items.

9. Transfer of ownership and right of disposal

Ownership and the right to dispose of purchased property transfer to the buyer when the purchase price has been paid in full.

10. Collection of items

The buyer is responsible for transporting the items away. If the buyer arranges a carrier to collect the purchased item, the buyer must notify the seller in advance. The seller will release items only upon presentation of payment confirmation and/or receipt. If packaging and delivery have been ordered/paid, the goods will be delivered by the seller.

All successfully won items must be removed within 7 (seven) days of the auction closing unless otherwise agreed with the seller. The seller may charge rent for the space occupied by the won item, indoors or outdoors, for any period exceeding seven days at a reasonable daily rate. If items are not collected within 3 (three) months, the seller reserves the right to apply the Act on the Right of an Entrepreneur to Sell an Uncollected Item (15/07/1988/688).

11. Additional costs

The seller reserves the right to charge collection fees and any other incurred additional costs and/or costs caused to third parties to the buyer.

12. Withdrawal from a bid

If the buyer withdraws from an accepted bid with the seller’s consent, the buyer must reimburse the seller for costs incurred from the failed auction (27/03/1987/355 and 05/01/1994/16). The compensation for cancelling a binding sale is 10% of the purchase price, but at least €100. Compensation is exempt from VAT under the VAT Act.

13. Validity of the auction terms

These auction terms entered into force on 17/05/2015 and replace the previous terms.
