Auction Terms and Conditions for Transactions Between Users

Please note that this is a translation of the Finnish language version of the Auction Terms and Conditions for Transactions Between Users. In case of any discrepancies between the Finnish version and this English version, the Finnish version shall prevail.

These Auction Terms and Conditions apply to all items sold in auctions listed in the Huutokaupat.com service where these Auction Terms and Conditions have been referred to in the listing. Huutokaupat.com (i.e. Mezzoforte Oy, business ID 2004568-7) is not a party to any transaction concluded under these Auction Terms and Conditions. Huutokaupat.com is acting solely in the role of the organizer of the auction.

1. Taking part in an auction, placing bids, and binding effect

• Auctions may be participated in electronically on the Huutokaupat.com website after registration as a user and acceptance of the terms and conditions.
• Each bid placed through the Huutokaupat.com service is binding until a higher bid is placed and accepted in the auction. At the end of the auction, only the highest bid is binding. Terms related to a possible statutory withdrawal can be found in the listing pertaining to the item.
• The Seller shall have the right to accept or reject the highest bid submitted, unless otherwise specified in the listing. The Seller shall aim to give notice of the acceptance or rejection of the highest bidder as soon as possible. If the highest bidder is not accepted or rejected within two (2) weekdays of the auction closing, the bid shall no longer be binding on the buyer.

2. Terms relating to the conclusion of transactions

• Unless otherwise specified in the listing pertaining to an auction, the rights of ownership and possession of the item comprising the subject of the auction are transferred to the buyer when:
  i) the Seller has given notice of its acceptance of the bid;
  ii) the buyer has paid the purchase price to the Seller in accordance with the provided instructions; and
  iii) has received confirmation of their payment and the conclusion of the transaction.
• Huutokaupat.com is not a party to the transaction and the role of Huutokaupat.com is limited to the organization of the electronic auction proceedings and the transfer of information between the parties to the transaction. Responsibility for the transaction (also including the liability for defects pertaining to the item and responsibility for payments) lies with the parties to each transaction in accordance with the applicable legislation and the agreements (incl. these terms and conditions and any other terms and conditions specified in the listing pertaining to the auction) concluded between the parties to the transaction. Huutokaupat.com shall not accept any responsibility regarding transactions concluded between users.

3. Other terms

• Each auction is also subject to the sales terms specified and/or referred to in the listing pertaining to the auction as well as the Terms and Conditions of Huutokaupat.com in force at each time, which also comprise stipulations and restrictions concerning the liability of Huutokaupat.com.

Huutokaupat.com has the at any time to amend these terms and conditions. Each auction is subject to the version of the terms and conditions that was available on the Huutokaupat.com website at the start of the auction.
