Auction Listing Policy
Please note that this is a translation of the Finnish language version of the Listing Policy. In case of any discrepancies between the Finnish version and this English version, the Finnish version shall prevail.
- Any information that can reasonably be expected to affect the price of the auction item must be clearly stated in the auction listing. For example, the observable condition, characteristics, defects, faults, and damage of the auction item must be clearly indicated. The advertiser is responsible for ensuring that the information provided in the advertisement is accurate and truthful, and the advertisement must not contain any misleading information. The advertiser is liable for any errors in the advertisement.
- The purpose of the title is to state, simply and concisely, what is being auctioned. It must not include a comparative price, special symbols, emojis, or the auction publisher's own promotional information.
- The listing may only be used to market the auction item being listed. Bonus items and additional services are prohibited. Linking to other websites is prohibited.
- The listing must be published in the category corresponding to the item’s intended use or, if no such category exists, in the ‘Other’ category. Huutokaupat.com reserves the right to remove or transfer an auction item listed in the wrong category.
- Advertisements must be neutral in appearance and content, and comply with the law, in particular consumer protection regulations. For example, exclamation marks, capital letters and other means of emphasising the content must be avoided. Advertisements must not contain exaggerated claims.
- Images in auction listing must always be of the specific auction item being sold, with the exception of new, unopened products. The auction publisher must have the right to use the images. Apart from images that present the item in a neutral manner, no other information may be added to the images, nor may any highlighting techniques or image editing be used that give a false or misleading impression of the auction item. Images in the auction listing must not show the advertiser’s or any other person’s names, contact details or other personal data (e.g. a photo of a service book).
- Any comparative price quoted for the item in the auction listing must correspond to the general market price. If the price quoted in the auction listing does not reflect the prevailing market price of the item, its use is considered misleading and is prohibited on Huutokaupat.com. Upon request, the auction publisher must be able to provide evidence that the reference price stated in the auction listing corresponds to a realistic and up-to-date market situation. The reference price stated in the auction listing must be accurate, realistic and justified.
- Delivery costs relating to the auction item must be clearly stated in the auction listing. Delivery costs must be reasonable and comply with applicable regulations. For items that cannot be sent as standard postal parcels, the option to collect the item from the address specified in the auction listing must always be offered. Huutokaupat.com reserves the right to reclaim from the auction publisher any delivery costs that exceed the amount of direct delivery costs actually incurred by the auction publisher.
- Costs relating to the acquisition and use of the auction item (e.g. taxes and other charges that are outstanding or due to be paid) must be clearly stated in the listing. Tax information (including value added tax related information) must be provided accurately and correctly.
- As a general rule, Huutokaupat.com’s standard texts are added to auction listings (link here). Any exceptions will be indicated during the auction listing submission process. It is prohibited to include terms and conditions of sale in the listing that contradict the standard texts. Under no circumstances may terms be added to a listing that contravene applicable legislation, or that increase Huutokaupat.com’s liabilities or weaken Huutokaupat.com’s legal position compared with the situation set out in the standard terms and conditions.
- The listing must include the information required under the Consumer Protection Act, including details regarding the right of withdrawal as set out in the Consumer Protection Act. These terms do not need to be added separately if the item is being sold as a Huutokaupat.com transaction, or if the Consumer Protection Act does not apply to the advertiser (e.g. sales by public authorities).
- Huutokaupat.com reserves the right to change the auction closing time, as well as to edit and cancel listings. The auction must last for at least 12 hours.
- Bids made on behalf of the item’s owner or their close circle are strictly prohibited. The auction publisher must immediately notify Huutokaupat.com (asiakaspalvelu@huutokaupat.com) if they suspect any fraudulent activity.
- The auction publisher has the right to reject the highest bid, unless the item is being sold under ‘Sold to the Highest Bidder’ clause. However, Huutokaupat.com reserves the right, at its discretion, to intervene in the activities of any auction publisher whose rejection rate deviates from Huutokaupat.com’s usual level.
- The item may not be listed for sale elsewhere at the same time. Accepting the highest bid and listing the item under the ‘Sold to the Highest Bidder’ condition means that the item must be sold at the price indicated by the highest bid.
- All bids for the item must be submitted to Huutokaupat.com via the Huutokaupat.com service. Bids to be sent directly to the auction publisher must be agreed separately with Huutokaupat.com.
- Cancelling an auction without a valid reason is prohibited. An auction started on a “sold to the highest bidder” basis cannot be cancelled whilst the auction is in progress without the written permission of Huutokaupat.com.
- Further details on the terms and conditions applicable to listing auction items can be found in the publisher terms (link here). If you have any queries, please contact us by email at asiakaspalvelu@huutokaupat.com, where your enquiry will be forwarded as necessary. Breach of this policy may result in the loss of the right to use the service, liability for damages and other penalties.
Huutokaupat.com reserves the right to amend this policy. Huutokaupat.com will notify auction publishers in writing in advance of any changes and their effective date.
